This Privacy Notice (“Notice”) describes how Cinemark USA, Inc., including each of its operating entities, subsidiaries and affiliates (collectively, “Cinemark,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information. This Notice also tells you about your rights and choices with respect to your personal information, and how you can reach us with any questions.

This Notice applies when you: 

  • visit our website located at www.cinemark.com and any other websites, pages, features or content we own or operate that links to this Policy (the “Site”);
  • use the Cinemark Theatres Mobile App or other Cinemark owned and operated mobile applications (the “Apps”);
  • visit and interact with us in our theaters (the “Theatres”); or
  • otherwise engage our products or services that links to this Notice (collectively, with the Site, the App and the Theatres, the “Services”).

This Notice may be updated from time to time without prior notice. We always indicate the date the last changes were published. Accordingly, you should check the date of this Notice (which appears at the top of this page) and review any changes since the last version. If we make a change to this Policy that we believe materially affects how we process your personal information or reduces your rights, we will provide you with advanced notice via email, through push notification, or by posting a prominent notice on our Services. We may provide “just-in-time” disclosures or additional information about our information collection, use and sharing practices of specific services. These notices may supplement or clarify Cinemark’s privacy practices or may provide you with additional choices about how we process your personal information.

Cinemark collects personal information when you interact with our Services. The definition of personal information depends on the applicable law based on your physical location. Only the definition that applies to your physical location will apply to you under this Privacy Notice. Personal information in this Notice generally refers to any information that identifies or makes an individual identifiable. We collect information about you in a variety of ways depending on how you interact with us and our websites, mobile applications, products, and services, including:

  • Directly from you when you provide it to us, such as when you register for an account, subscribe to receive communications from us, place an order/make a purchase, or contact us by phone, email, or otherwise.
  • Automatically through the use of cookies, server logs, and other similar technologies when you interact with our websites, mobile applications, emails, and advertisements.
  • From other sources, including, for example, our affiliates, business partners, service providers, online social media networks, and other third parties, or from publicly available sources. If you receive email from us, we use certain tools to capture data related to when you open our message, click on any links or banners it contains and make purchases. To understand how you interact with our communications to you.

When you participate in a sweepstakes or contest, we collect information about you which includes contact information to notify you if you are selected. To operate the sweepstakes or contests. In some   contexts we are also required by law to collect information about those that enter into our sweepstakes.
CCTV We may use closed-circuit television, video recordings, photography, and/or similar technology to monitor our Theatres or offices. For security, fraud, loss prevention, incident reporting, and operational purposes. We may also collect and aggregate data from video recordings and photographs for a variety of  purposes, including to track and analyze how individuals move through the store, analyze trends, make changes to the layout, and optimize patron experience.


How We Use Information


In addition to the purposes and uses described above, we use information in the following ways:

  • To identify you when you visit our websites or our locations.
  • To process and fulfill orders and provide products and services.
  • To improve or create Cinemark services and product offerings.
  • To streamline the checkout process.
  • To conduct analytics.
  • To communicate with you, such as to respond to and/or follow-up on your requests, inquiries, issues, or feedback.
  • To send marketing and promotional materials including information relating to our products, services, or promotions, or those of our business partners. Please note that you may unsubscribe from any promotional email communications by clicking the “unsubscribe” link contained within each such email.
  • To provide you with a more personalized, quick, convenient shopping and rewards experience.
  • To detect and protect against malicious, deceptive, fraudulent, or illegal activity, including violation of our policies and terms and conditions, security incidents, and harm to the rights, property, or safety of our company and our users, employees, or others.
  • To debug, identify and repair errors that impair existing intended functionality of our website and services.
  • To comply with our legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim.
  • For internal administrative purposes, as well as to manage our relationships.
  • For such other purposes as you may consent (from time to time).

How We Share Information

In addition to the specific situations discussed elsewhere in this Notice, we may disclose personal information in the following situations:

  • Affiliates. We may share information with our corporate affiliates (g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control).
  • Business Transactions. We may disclose personal information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our customers or end users is among the assets transferred. You agree to and do hereby consent to our assignment or transfer of rights to your personal information, unless you notify us as described below and ask to be opted-out.
  • Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third-party intermediary.
  • Partner Promotion. We may offer contests, sweepstakes, or other promotions with third party partners. If you decide to enter a contest, sweepstakes, or promotion that is sponsored by a third party partner the information that you provide will be shared with us and with them. Their use of your information is not governed by this Notice.
  • Service Providers. We may share your information with service providers who perform business tasks pursuant to our instructions and on our behalf. Among other things service providers may help us to administer our website, conduct surveys, provide technical support, analytics, storage, process payments, and assist in the fulfillment of orders.
  • Other Disclosures with Your Consent. We may disclose your information to other third parties when we have your consent or direction to do so.

Cookies and Similar Tracking Technologies

We use a variety of technologies such as cookies, web beacons, clear GIF, and browser/web logs to gather information when you visit or interact with our websites, mobile apps, and email communications. 

• Cookies. "Cookies" are small pieces of information that are stored by your browser on your computer. The following describe the types of cookies we use and why:

Necessary and Functional. Some technology is needed for the operation of our website. This includes cookies that enable basic functions such as page navigation and access to secure areas of the website. Because our website cannot function properly without this technology, it is always active. Note that while you can set your browser to block this type of technology, doing so may cause some parts of our websites to not work.
Analytics. Analytics technologies are primarily used to improve our products, services, and user experiences, including the operation and layout of our website. Analytics may be conducted by us or one of our service providers. For example, for the purpose of enabling better website design and a better user experience, we employ Google Analytics to track website traffic and provide aggregate reports of how the public interacts with our website. Google Analytics analyzes website usage information automatically upon visits to our website. Some tracking is used to collect information about how you use our website, such as which pages you visit, how often you visit, and where you are visiting from. If you do not allow us to use analytics cookies and technologies, we will not be able to easily monitor our performance to improve our services.
Advertising. Advertising tracking technology, such as behavioral advertising cookies, may be set by us, or by third parties. The technology is used to deliver advertisements that may be relevant to you, to limit the number of times you see an advertisement, to help measure the effectiveness of advertising campaigns, or to understand your behavior after you view an advertisement.

• Opting Out of Cookies. To learn how to opt out of ad network interest-based advertising generally in the U.S., please visit both www.aboutads.info/choices and http://www.networkadvertising.org/choices/. Many advertising companies that collect information for interest-based advertising are members of the Digital Advertising Alliance (DAA) or the Network Advertising Initiative (NAI), both of which maintain websites where people can opt out of interest-based advertising from their members. To opt out of website interest-based advertising provided by each organization’s respective participating companies, visit the DAA’s opt-out portal available at www.optout.aboutads.info/, or visit the NAI’s opt-out portal available at https://optout.networkadvertising.org/?c=1.

• Web beacons. These are small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs”) that may be included in our web pages and e-mail messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to our website, to monitor how users navigate our website, as an identifier, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed.

• Embedded Scripts. An embedded script is a programming code that is designed to collect information about your interactions with our website and mobile application, such as the links you click on.

• Custom Audiences. Using Facebook Business Tools, we may display interest-based ads to you when using Facebook.  To modify your preferences or turn off personalization for ads served by Facebook, you can visit Facebook's Ad Preferences in addition to the Your Rights and Choices section below.  We do not share any of your personal information with Facebook.  We may also show ads to audiences that share similar characteristics as you.  To do so, a list of email addresses is irreversibly encrypted through hashing and uploaded or transmitted from our site, and Facebook matches the hashed data against its own users, generating a lookalike audience and deleting the uploaded list.  We do not have access to the identity of anybody in the “lookalike” audience, unless they choose to click on one of our advertisements.

Computer and Device Information

We log your current Internet address (this is usually a temporary address assigned by your Internet service provider when you log in), the type of operating system, the type of browser software and the type of mobile device being used. In addition, we may keep track of which areas of cinemark.com or Cinemark mobile app you are visiting. We aggregate this information to help us improve or create a better experience for users of cinemark.com or Cinemark mobile applications. Our website and mobile applications automatically record usage information that we analyze statistically to track operational problems, to prevent fraud and to improve the effectiveness, security and integrity of the website and mobile application. For each page that you visit during your use of our website and mobile application, we collect and store the following technical information:

  • Date and time of access
  • URL address of the cinemark.com webpage visited
  • App launches, taps, clicks, scrolling information, video views, saved place in a video, or other information about how the user interacts with the app
  • Your general (not precise) location
  • Internet domain and IP address from which cinemark.com was accessed
  • Type of browser and operating system used to access cinemark.com (if provided by the browser)
  • URL address of the referring page (if provided by the browser)
  • Completion or success status of the request for a web page or other on-line item
  • App crash data as crash logs, and performance data such as launch time, hang rate, or energy use
  • File size of the webpage visited

Tracking

As described above, we use Google Analytics. We may also permit Google Analytics to make use of a feature called User-ID. This functionality allows for more accurate analytics by using the same user identifier over various sessions and devices, including session unification of your interactions prior to logging in to the website if you login during that same session.

Because we link to social media sites, and from time to time may include third-party advertisements, other parties may collect your information about your online activities over time and across different web sites when you visit cinemark.com.

The following information is used for tracking purposes by us or by third parties:  email address, user ID, Device, ID, purchase history and interaction with our website or mobile application. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics, available at: https://tools.google.com/dlpage/gaoptout.

Your Rights and Choices

Depending on applicable law where you reside or are located, you may be able to assert certain rights identified below with respect to your personal information. Please refer to the chart immediately below to determine the rights you have in your U.S. state jurisdiction. If any of the rights listed below are not provided to you under the law that governs the processing of your personal information, we have absolute discretion in providing you with those rights. Depending upon the applicable law, access to your rights under the applicable law may be denied: (a) when denial of access is required or authorized by law; (b) when granting access would have a negative impact on another's privacy; (c) to protect our rights and properties; or (d) where the request is frivolous or vexatious, or for other reasons.

a. Right to Know/Access. You may have the right to obtain a copy, or a list of categories of the personal information that we hold about you, as well as other supplementary information, such as the purposes of processing, and the entities to whom we disclose your personal information.

b. Right to Correct. You may have the right to correct any of your personal information in our records and systems. You may request us to rectify, correct or update any of your personal information held by us that is inaccurate.

c. Right to Delete. In certain jurisdictions, applicable law may give the right to request that we delete the personal information that we hold about you, subject to certain exceptions. This right is not absolute, and we may refuse such a request if there are compelling legitimate grounds for keeping
your personal information, for legitimate purposes, or as required by law. In addition, in the event your deletion request is honored, we may retain a record of your deletion request as required under applicable law.

d. Right to Opt-Out Sale or Sharing of Personal Information to Third Parties. You may have the right to opt-out of sale of your personal information or the sharing of personal information for cross-contextual behavior advertising. Please also see subsection (e) immediately below.

e. Right to Opt-Out of Targeted Advertising.Like many websites, we use cookies, pixels, and similar technology, and we share certain personal information, such as your IP address or device identifiers, to certain third-party advertisers in order to improve your user experience and to optimize our marketing activities. You may have the right to direct us not to share your personal information for targeted advertising purposes. You may opt-out of online tracking based targeted advertising (e.g., cookies) by clicking the “Your Privacy Choices” link on our website homepage. Please note that if you change browsers or devices, or if you clear your browser’s cache, you may need to click the link again to apply your preference. You may also opt-out of other forms of targeted advertising by submitting a request as described below. We also recognize Global Privacy Control (GPC) signals enabled by customers on their web browser or web browser extension as valid opt-out requests where required by applicable law. f. Right to Limit Use and Disclosure of Sensitive Personal Information. If you are a California resident, to the extent your Sensitive Personal Information, as that term is defined under California privacy law, is used to infer characteristics about you, you have the right to object to our processing of your Sensitive Personal Information. We do not engage in this practice.

g. Right to Opt-Out of Automated Decision-making or Profiling. You may have the right not to be subject to a decision which significantly impact your rights that is based solely on automated processing (where a decision is taken about you using an electronic system without human involvement). No decision which has a significant impact on you will be made by us solely on the basis of automated decision-making.

h. Right Against Discrimination. You may have the right not to be discriminated against for exercising any of the rights described in this section. We will not discriminate against you for exercising your rights.

i. Right to Portability. You may have the right to receive a copy of the personal information we have collected about you in a structured, commonly used and machine-readable format.

j. Right to Withdraw Consent. In certain jurisdictions, to the extent the processing of your Personal Information is based on your consent, you may withdraw your consent at any time. Your withdrawal will not affect the lawfulness of our processing based on consent before your withdrawal.

k. Right to Appeal. In certain jurisdictions, you may have the right to appeal if we refuse to take action on your rights request. Instructions on how to appeal will be provided to you upon such a denial, but in any event, such instructions will be substantially similar to those provided below for submitting requests.

l. Shine the Light. If you are a California resident, you have the right to ask us for a notice describing what categories of personal information we share with third parties or corporate affiliates for those third parties’ or corporate affiliates’ direct marketing purposes. That notice will identify the categories of personal information shared with third parties and used for direct marketing purposes and the name and address of the third parties that received such personal information.

As noted above, depending on where you reside or are located at the time your personal information is collected, you may be able to assert certain rights with respect to your personal information. To determine which rights you have, please refer to the table below that references the rights as described
above. U.S. States not listed either do not have a law providing such rights, or it does not apply to our operations. If your country is not listed, please reach out for more information about your rights under the applicable law.

Promotional Text Messages. If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP.”

Please note, not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law.

Submitting Requests

You may submit a request to exercise the rights described above by calling us at 1-800-CINEMARK or submitting your request via cinemark.com/my-personal-information. If you disagree with our denial of a request, you may appeal our decision by contacting us with the subject line “Appeal.”

Note that, as required by law, we will require you to prove your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name and email address.  We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete personal information about you in our files.

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. If you are an authorized agent submitting a request on behalf of an individual, you must complete the Authorized Agent Designation Form via cinemark.com/my-personal-information indicating that you are able to act on another person’s behalf.

How We Protect Information

No method of transmission over the internet, or method of electronic storage, is fully secure. While we use good faith efforts designed to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Some of our websites permit you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. We strongly ask that you do not share your password or re-use any passwords that you use on other services.  You should notify us of any unauthorized use of your password or account.

How Long we Retain Information

We retain your personal information for only as long as necessary to fulfil the purposes outlined in this Privacy Policy, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we obtained the information and whether we can achieve those purposes through other means, as well as applicable legal requirements.

Third-Party Applications/Websites

For your convenience, we may provide links to websites and other third-party content or services that we do not own or operate. The websites and third-party content to which we link may have separate privacy notices or policies. Please note, we have no control over the privacy practices websites, or services that we do not own. We encourage you to review the privacy policies of any third-party website or application for details about such third party’s privacy practices.

Changes To This Notice

We may change this Notice and our practices over time. To the extent that our Notice changes in a material way, the Notice that was in place at the time that you submitted personal information to us will generally govern that information unless we receive your consent to the new Notice. This Notice includes an “effective” and “last updated” date. The effective date refers to the date that the current version took effect. The last updated date refers to the date that the current version was last substantively modified. If we make a material change to our privacy notice, we will attempt to notify you through email or through a website pop-up.

Children

Our websites and online services are not intended for children under the age of 13 and we do not knowingly collect personal information from children under age 16, without parental consent. Children under the age of 13 should not provide their personal information to us.

Additional Information For California Residents

California law requires us to disclose the following additional information related to our privacy practices. If you are a California resident, the following privacy disclosures apply to you in addition to the rest of the Notice.

• California Shine the Light. If you would like more information concerning the categories of personal information (if any) we share with third parties or affiliates for those parties to use for direct marketing, please submit a written request to us using the information in the Contact Information section above.

California Notice of Financial Incentive. From time to time, we offer programs that provide certain perks, such as rewards, discounts, and exclusive offers that require the collection of certain personal information. For example, we require certain personal information from you to sign up for the Cinemark Movie Rewards loyalty program and/or to participate in certain sweepstakes or giveaways. Cinemark loyalty program members or sweepstakes participants may receive such benefits as birthday rewards, upgrades on food and beverage items, waived convenience fees, prizes, and accrual of points that they may redeem. Categories of personal information that we may collect when you sign up may include your name, email address, phone number, birth date, physical address, and location. Under California law, the Cinemark loyalty program and/or our sweepstakes or giveaways might be interpreted as “financial incentive” programs as they involve the collection of personal information. We do not assign a monetary value to the information we collect. Based on our reasonable estimate, the value of your personal information to us is related to the value of the free or discounted products or services that you obtain when you redeem points. This value is based on the expense related to offering those free or discounted products or services. Signing up for the Cinemark loyalty program or any promotional sweepstakes or contest is optional. You have the right to withdraw from the loyalty program or any promotional sweepstakes or contest at any time. If you wish to withdraw from participating, you may submit such a request at any time by deleting your loyalty account or by submitting a request here (https://www.cinemark.com/my-personal-information). • Categories of Information We Collect, Use and Disclose. California law indicates that organizations should disclose for California residents whether certain categories of information are collected, disclosed for an organization’s “business purpose”, “sold” or “shared” for purposes of cross-context behavioral advertising (as those terms are defined under California law). For more information generally, see the “Information We Collect”, “How We Use Information”, and “How We Share Information” sections above. In relation to California law, the table below describes the categories of personal information we collect, disclose for a business purpose, and “share” for purposes of cross-context behavioral advertising (as those terms are defined by California law).
